At a Court of Probate Held in Woodbury April 5th 1768 Moses Terrill Executor on the Last Will of Josiah Terrill Late of Waterbury decd appeared and Exhibited sd Will in order to its approbation the Which being read and Considered and No objection made against it Now allowed and approved and accepted to be Recorded and is as followeth sd Executor accepting of sd Excutorship ~

The Will

In the Name of God Amen

I Josiah Terrill of Waterbury in the County of New Haven in Connecticut being of an advanced age but now in health and of Prefect mind and memory Calling to mind ye mortality of my Body an Knowing that it is appointed for all men once to Die do make & ordain this to be my Last Will and Testament, that is to say Principally and first of all I Give and Recommend my soul to God that gave it and my Body to ye Earth to be Buried in a Decent and Christian Burial after the Discretion of my Excutor Nothing Doubting but at the General Resuricktion I shall Receive ye same by the almighty Power of God and as Touching such Worldly Estate Wherewith it hath pleased God, to Bless me in this Life I Give Domise and Dispose of ye same in the following manner and form.

Imprimess I Give and bequeath unto my Beloved Wife Mary Terril one-half my Dwelling House and half an acre of Land Joinning therer to and all the appurtenances thereof to be to her proper use and Improvement and absolute Dispose for ever.

also I Give to my Beloved Wife the use of three acres of Land in my Plain Lot and two acres, and two acres [sic] out of my Orchard and all my Land lying on the side of the hill between the meadow and Country Road - and two acres of Meadow lying at the uper End of Olivers Meadow. Next Joining thereunto and Eight acres of my land Called James's Land for her to be freely used and Improved During the Term of her Natural Life and afterward to be Disposed of according to the Division made by my sons: also I Give unto the sd Mary my Wife one Rideing Horse and two Coltes to be at her absolute Dispose to be maintained and Kept Good to her During her Natural Life.

Also I Give to my sd Wife all my moveable Estate Except the Irons belonging to my Cart for her own Disposeall.

Item I Give & bequeath unto My beloved Moses Terril Whom I ordain to be the sole Executor of this my last will and Testament My Cart Irons and the Land according to their Divisions Except the use of one acre of Meadow Which is Given to my Wife during her Life and Ten Pounds Value in Land to be taken at an Inventory Price to be given to my two Daughters he finding two Bushells of Wheat and ten Pounds of Beaf and ten Pound of Pork & 3 lb of Tallow and one Bushell of Indian Corn for my Wife Dureing life yearly.

Item I Give and bequeath unto my beloved son Aaron Terril the Land according to their Divisions Except the use of two acres of land of the orchard and half an acre of Land in the Plain lot which is Given to my Wife During her Life and ten pounds Value in land to be taken att an Inventory price to be given to My Daughters, he finding two Bushsells of Wheat and one-bushell of Indian Corn and Ten pound of Beaf and ten pounds of Pork and three pounds of Tallow for my Wife Dureing her life yearly.

Item I Give and bequeath unto my beloved son Oliver Terrill ye the Land according to their Division Except ye use of the land Lying on the Side of the hill between the meadow & Country Road, Which is Given to my Wife dureing her life and ten Pounds Value in Lands to be taken at Inventory price to be Given to my Daughter he finding two Bushells of Wheat and one Bushells of Indian Corn and ten pounds of Beaf and ten pounds of pork & 3 pounds of Tallow for my Wife dureing her life yearly

Item I Give and bequeath unto my beloved son Josiah Terrill ye according to the Division Except ye use of two acres and a half of ye Plain Lot Which is Given to My Wife Dureing her life and ten pound Value in land to be taken at Inventory price for my Daughters, he finding two Bushells of Wheat and one Bushell of Indian Corn and ten pound of Beaf and ten pound of pork and three pounds of Tallow for my Wife Dureing ^ her life yearly.

Item I Give and bequeath unto My beloved Son Isaac Terrill the Lands according to their Division Except the use of Eight acres of James Land Which is Given to my Wife Dureing her Life to be Given to My two Daughters he also finding two Bushells of Wheat, one Bushell Indian Corn and ten pounds of Beaf & ten pounds of pork and three Pounds of Tallow for my Wife Dureing her Life yearly.

Item I Give and bequeath unto my beloved Son Israel Terrill the Land acording to their Divisions Except ye use of one acre of meadow land which is Given to my Wife Dureing her Life and Ten Pounds Value of land to be taken at Inventory price for my Daughters, he finding ten pounds of Each Pork and Beaf and two Bushels of Wheat and one Bushel of Indian Corn and three-pound of Tallow for my Wife Dureing her life yearly.

Item I Give to my beloved Daughters, Eunice and Mary Terrill the Vallue of Thirty Pounds Each to be taken out of the Lands at an Inventory Price; And I Do hereby utterly Disalow, Disanul and Revouk all and Every Other former Wills and Testaments, Legacies, Bequests and Executors by me in any Way before Willed or Named Rectifying and Confirming this and No other to be my last Will and Testament in Witness Whereof I have hereto Set my hand and Seal this 7th Day of April AD 1764.

Signed, Sealed Published, Pronouned an Declared by the Said Josiah Terrill to be his Last Will and Testament. In presence of us Who in his Presence and in the Presence of Each other Subscribe our Names.

Whereas Mr. Josiah Terrill Late of Waterbury in New Haven County Decesd, in his lifetime made & Executed his Last Will and Testament Dated the 7th Day of April - Anno Domini 1764 and at his Death Left the same in order that a Just Division & Distrebution of his Estate might be made thereby, to an amongst his Heirs & Legatees, and that the Same may be Effected in the best & most amiable Manner: We Mary Terrill Relict of the sd Decesd, and Moses Terrill, Aaron Terrill, Oliver Terrill, Josiah Terrill, lsaac Terrill, Israel Terrill and Eunice Terrill, all of Waterbury aforesd and Caleb Tuttle & Mary Tuttle being Husband & Wife, of Woodbury in the County of Litchfield, being all the Heirs & Legatees of the sd Decesd, and being Desirous that the sd Estate might be Irevoakeably Settled accordin to the sd last will & Testament, have Covenanted and agreed & by these presents do Covenant and agree that the Estate of the sd Decesd Shall be Distributed Divided and Settled according to the Discription Given in the sd Last Will & Testament wihout the Least alteration or Deviation therefrom and we the sd Heirs and Legatees Do by these Presents Bind our selves, our Heirs Executors and assigns forever to abide by such Distribution and Division whenever it shall be Effected by our Selves or by Distrebutors appointed by the Honorable Court of probate according to sd Will, and that Each Legatee mentioned or Named in^ye sd Shall Quietly and Peaceably Possess and Enjoy such part of the sd Estate as is discribed in sd will and given thereby to such Legatees, Whither Real or personall Without the Least Hindrance or molestation by Either of us who may be the other Heirs and Legatees Named in sd Will or by our Heirs Executors or Administrators or by any Person by our Means or Procurement, in Witness whereof we have hereunto set our hands and seals this 15th Day of February in the Eighth year of the Reign of our Soverign Lord George the 3rd of Great Britain etc. King Anno Domini 1768 Signed, Sealed and Delivered
